Game in the Gulf Magic Online Championship

Official Rules for the Game in the Gulf Magic Online Championship Tournament

To enjoy the prize, winner must be able to travel on the Game in the Gulf Cruise, which runs from February 7 – 12, 2009 and deports from Galveston, Texas. If winner cannot travel during the dates of the cruise, or he or she is below the age of majority in his or her state of residence, the prize will be forfeited and Sponsor may select an alternative winner who had the next highest score in the Championship.

Legion Events and Gamer Adventures are partnering to offer Game in the Gulf; a Magical Cruise, which is a premier event that offers exciting opportunities to play Magic the Gathering while enjoying a cruise experience. Game in the Gulf is a 5 day cruise adventure that leaves from Galveston, TX and runs February 7 – 12, 2009 filled with various Magic the Gathering tournaments and workshops plus the opportunity to vacation with Magic the Gathering VIPs. Who is Eligible?

If you missed the chance to register for the Game in the Gulf, Magical Cruise, and you are above the age of majority in your state of residence, you may still receive a trip by participating in the Game in the Gulf Magic Online Championship Tournament ("Tournament"). The winner of the Tournament, who is above the age of majority, will win a FREE spot on the cruise for themselves and a guest, including the gamer registration fees. VOID WHERE PROHIBITED.

How to Play?

First, you must qualify during the Qualifier Preliminary Top 8 Tournaments or the Last Chance Qualifiers. Here are the details:

Game in the Gulf Magic Online Championship Preliminary Top 8 Tournaments

Dates: 12:01 a.m. Pacific Time ("PT") on Wednesday, November 26, 2008 through 11:59 p.m. PT on Tuesday December 02, 2008 ('Qualifying Term").

During the Qualifying Term, thirty-two (32) Daily Events will be designated Game in the Gulf Prelim events (GitG Prelim). See the Magic Online Event Schedule for a complete schedule of Game in the Gulf Prelims.

Prizes: Prizes for the Game in the Gulf Prelim games will be paid as follows.

Boosters are prizes that are awarded to each person who places as described above. In addition, each Game in the Gulf Prelim will invite the Top 8 finishers to play in the Game in the Gulf Magic Online Championship on Saturday December 6, 2008 at 9:00 AM PST.

Game in the Gulf Magic Online Championship Last Chance to Qualify Queues

After the completion of the scheduled Top 8 Qualifier tournaments we will run Last Chance to Qualify Queues for approximately 36 hours running from Wednesday December 3 after the weekly downtime (approximately 12:00 PM PST) until 11:59 PM PST Thursday December 4.

These 8-player single elimination queues will award the 1st place finisher an invitation to compete in the Game in the Gulf Magic Online Championship. No other prizes will be awarded in these queues.

Game in the Gulf Magic Online Championship

The players who successfully make it through the Game in the Gulf Prelim will be invited to participate in the Game in the Gulf Magic Online Championship ("Championship"). Here are the details of the Championship:

START TIME: Saturday December 6, 9:00 am PST

FORMAT: Standard

Boosters are prizes that are awarded to each person who places as described above. In addition, one person will win the Championship and receive accommodation, meals, and entertainment aboard the Carnival Ecstasy cruise ship during the Game in the Gulf premier event. Details are provided below.

In addition, the winner of the Game in the Gulf Championship receives an invitation to the 2008 Game in the Gulf in Galveston, TX, USA, including two round-trip economy-class tickets from the airport nearest the winner's location to Galveston, TX, USA*.

Prize Details

One person will receive the Championship prize package, which includes two round-trip economy-class airline tickets, two tickets on the Game in the Gulf cruise, which will include double occupancy accommodations, gamer fees, food, all shipboard entertainment, and attendance to one hosted cocktail party. The cruise shall be February 7 – 12, 2009.

Odds of winning a prize depend on the number of participants and the skill of the participants.

Prize Restrictions

No substitution of prize is offered, no transfer of prize to a third party is permitted, and non-cash prizes cannot be redeemed for cash value, except in the case of the Cash Equivalent Award or as determined in Wizards' sole discretion.

Alcoholic beverages, gratuities, and transportation to and from the cruise ship itself in Galveston, Texas and all other fees, costs, and expenses not specified herein are the winner's sole responsibility. All taxes are the sole responsibility of the winner. A representative of Wizards of the Coast, Inc. will contact the winner regarding this prize package. This prize is non-negotiable, non-transferable, and not redeemable for an alternate award except in Wizards' sole discretion. Cruise must be taken on the dates designated by Wizards, or prize will be forfeited and may not be re-awarded. However, Sponsor may, in its sole discretion, award the prize to the person with the next highest score in the Championship.

The winner will be required to sign and return prior to travel (i) a signed Consent and Release Agreement, (ii) the appropriate IRS tax form, (iii) proof of identification, and (iv) and other documentation designated by Wizards; failure to do so will result in disqualification. The forms must be returned within the time period specified by Sponsor.

The potential winner is responsible for ensuring that (s)he complies with all the applicable tax laws and filing requirements.

Participation Terms

Playing on another person's account, selling your account, etc. are all violations of these Official Rules. If you play in this Tournament, win, and expect to get a prize, be very, very sure you are on your own account. We do not recognize "I and a friend jointly own the account," "It's my brother's account but he gave it to me," or similar. The only exception is an adult may authorize a single dependent child age 13-18 to play on an account that adult has purchased.

Although players may have multiple accounts qualified for the Championship, players are not permitted to have more than 1 of their accounts entered in the Championship. Players are not permitted to have secondary accounts played by another person. If a player is discovered to have more than 1 account playing in the Championship before, during, or after the event, appropriate penalties will be applied (including disqualification from the event with no refund of product or event tickets). In such an event, Sponsor may select an alternative player in its sole discretion.

A list of all players that have qualified for the Championship will be maintained on the Wizards of the Coast web site, www.wizards.com. Players will be registered into the Championship the morning of the next day after they qualified. It will be the player's responsibility to make sure that they have been properly entered into this Championship and are able to join it PRIOR to the start of the Championship. If a player is qualified and is unable to join the Championship, they will need to contact customer service to get this corrected.

If a player wins that is ineligible to play in DCI™-sanctioned tournaments (i.e. DCI suspended and/or a paid contractor), then the Game in the Gulf accommodation prizes will pass down to the player with the next best finish. The final Swiss standings will determine the difference between third and fourth place and the difference between fifth through eighth place, should that be necessary. In the above case, the ticket and booster pack prizes will not pass down.

In either of the above cases, the booster pack prizes will not pass down.

In order to remain eligible for Prizes, all qualified players must email mtgotournaments@wizards.com by Friday, December 5th, 2008 at 10:00 AM PDT with the following information: Full Legal Name, Full Address, Telephone number, and DCI Number. Players must put their MTGO Username as the subject of the email. (Account passwords will not be requested--never give your password to anyone.) Please do not email unless you have already qualified for the Championship. Do not send an email for another player or account, and do not have another person send the email for you.

In addition, during the tournament, Wizards of the Coast staff (marked with the Wizards logo beside their online name) may ask players for their name and/or contact information. Do not give out your information to anyone who is not a Wizards of the Coast Staff (marked with the Wizards logo beside their online name).

Failure to provide accurate information may result in significant penalties, including suspension from online Magic tournaments up to and including termination of your Magic Online account.

All federal, state and local laws and regulations apply. Sponsor reserves the right to disqualify any participant from the Tournament if, in Sponsor's sole discretion, it reasonably believes that a participant has attempted to undermine the legitimate operation of the Tournament by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other participants, viewers, or the Sponsor.

* The Magic Online™ travel prize package includes round-trip, coach airfare for the winner and a guest from the major airport nearest the winner's home to Galveston, TX, USA to attend the Game in the Gulf held on February 7th through February 12th, 2009, two tickets on the Game in the Gulf cruise, which will include double occupancy accommodations, food on the ship, all shipboard entertainment, gamer fees, and attendance to one hosted cocktail party. Other meals, gratuities, ground transportation and all other fees, costs, and expenses not specified herein are the winner's sole responsibility. All taxes are the sole responsibility of the winner. A representative of Wizards of the Coast, Inc. will contact the winner regarding this prize package. This prize is non-negotiable, non-transferable, and not redeemable for an alternate award except in Wizards' sole discretion. Trip must be taken on the dates designated by Wizards, or prize will be forfeited and will not be re-awarded. Specific travel dates and arrangements are subject to availability. Winner and guest must travel together on same itinerary. The winner and his/her guest will be required to sign and return prior to travel (i) a signed Consent and Release Agreement, (ii) the appropriate IRS tax form, (iii) proof of identification, and (iv) and other documentation designated by Wizards; failure to do so will result in disqualification. Minors (i.e., those under 18 years of age) who win the Magic Online Game in the Gulf Championship are not eligible to be awarded the plane ticket and hotel travel award. Instead, minors will be awarded a "Cash Equivalent Award" equal to the cost of a round trip ticket to the Game in the Gulf, as determined by Wizards in its sole discretion. This award will be issued only if the player actually shows up to the Game in the Gulf in Galveston, TX on his or her own, and registers to play. Wizards will pay out this "Minor Qualifier Travel – Cash Equivalent Award" after the Game in the Gulf concludes.

Personal Information

Participants agree that personal data including, but not limited to, name, mailing address, phone number, and email address may be collected, processed, stored and otherwise used for the purposes of conducting and administering the Tournament. This data may also be used by Sponsor to verify a participant's identity, postal address and telephone number in the event a participant qualifies for the prize as well as to deliver the applicable prize. The data will be used in accordance with Sponsor's privacy policy, which is located on its web site, www.wizards.com.

During the tournament, Wizards of the Coast staff (marked with the Wizards logo beside their online name) may ask players for their name and/or contact information. Do not give out your information to anyone who is not a Wizards of the Coast Staff (marked with the Wizards logo beside their online name). Failure to provide accurate information may result in significant penalties, including suspension from online Magic tournaments up to and including termination of your Magic Online account. Release

By participating, all participants, on behalf of themselves, their executors, heirs and assigns, agree to release Wizards and its parent company, affiliates, subsidiaries, agents, employees and assigns (collectively, "Released Parties") from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses of any kind to persons or property which may be sustained in connection with the conduct of the tournament, the administration of this tournament, any event or condition caused by something beyond the control of Sponsor that may disrupt or corrupt the Tournament, any technical malfunction or problem that occurs during the Tournament, the receipt, ownership or use of a prize, or any printing or typographical error in any material associated with the Tournament. Under no circumstances will Wizards or its parent company or affiliates be liable for punitive, incidental, consequential, or any other damages.

System Crashing

If for any reason the Tournament is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Tournament, Wizards reserves the right at its sole discretion to cancel, terminate, modify or suspend the Tournament. Wizards further reserves the right to disqualify any participant who tampers with any part of the Tournament. Any attempt by a participant to deliberately damage any web site or undermine the legitimate operation of the Tournament is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such participant to the fullest extent of the applicable law.
Further, if during the scheduled Game in the Gulf Championship the system crashes, 1 of 2 things will happen:

  1. The system will come right back up. In this case:

    • The event will continue and additional time will be given to allow players to finish the event

  2. If the system cannot recover the event and "finishes" (prematurely ends) the event, or a WOTC Tournament Coordinator must "finish" (prematurely end) the event within 2 hours of the events scheduled start time:

    • The event will re-created and start over from the beginning. Results from the previous event will not be carried over.

    If the event is still in its Swiss Rounds though not the final Swiss round and has been running for more than 2 hours:

    • The event will be considered canceled and will be rescheduled for Saturday October 25, 9:00 am PST. Results from the previous event will not be carried over.

    If the event is in the final round of Swiss play:

    • The results of the last completed round of Swiss play will be official and the top 8 players from Swiss play will be invited to participate in an 8-player Single Elimination Standard queue and play it out to determine the final standings.

    If the event is in the Top 8:

    • The results of the last completed round of Single Elimination will be official and the remaining players will be invited to participate in a queue of the correct designated size (8, 4, or 2) and play out to determine the final standings.

Promotional Consent

By accepting the prize, participant agrees to allow Sponsor and its agencies, to use his or her name and/or likeness for advertising and promotional purposes without additional compensation, unless prohibited by law.

Governing Law

This promotion shall be governed by, subject to, and construed in accordance with the laws of the State of Washington, excluding all conflict of law rules. If any provision(s) of these rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

Winner's List

You may request the name of the prize winner after December 1, 2008 but before June 31, 2009 by sending a self addressed stamped envelope to: MTGO Community Manager, 1600 Lind Ave. SW, Suite 400, Renton, WA 98057. (Residents of Vermont need not supply postage).
